Acceptance of Terms and Conditions
By signing up and using the ecourse.org web site and its services, You (the "User" or "Member") agree to the following terms and conditions. ("We," or "the ecourse.org website") reserves the right to add, delete, or revise these terms and conditions at our sole discretion at any time with or without notice. All revisions will take effect immediately upon posting at this site or through any other reasonable means of notification, unless otherwise directed. Continued use of the ecourse.org site by you shall be deemed to constitute acceptance of all revisions.


Memberships
ecourse.org has the sole right to grant you permissions to use this site and its related services.  ecourse.org also reserves the right to terminate your membership if it is determined in our sole discretion that you violated this agreement.

This site is owned and operated by ecourse.org. The materials posted by schools, individual professors and students are protected by federal intellectual property laws.  Otherwise, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images are the sole property of ecourse.org. All software used on the site is the sole property of ecourse.org. You may use the content of this site only for the purpose of providing and receiving educational services on this site. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without ecourse.org prior written permission or their owners if posted by members. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.


Legitimate Use
You will use ecourse.org for legitimate purposes, in accordance with appropriate local, State and Federal Laws and Regulations. It is the User's responsibility to abide by all applicable laws and regulations. If, for any reason, any part of this Membership agreement is disallowed in the jurisdiction of the User, You acknowledge the enforceable terms remain in effect, and that those which are disallowed shall be enforceable to the fullest extent of the applicable law. No advice or information, whether oral or written, obtained by a User from ecourse.org, its officers, directors, employees or agents, shall create any warranty not expressly made herein.

You will use ecourse.org for its intended purpose of providing and receiving educational services. Any unauthorized use of the ecourse.org site, including, but not limited to unsolicited advertising ("Spamming"), the collection and/or sale of User information, or the unauthorized republication, in any format, of postings submitted to the ecourse.org site may result in the revocation of Membership. Any Member who sends spam and would, as a result, receive financial payment according to the ecourse.org Networking Program, shall immediately forfeit all rights to said payment. ecourse.org will be the sole arbiter in determining what constitutes spam.

In posting any information, including, but not limited to lecture notes, presentations, computer programs, project reports, You will not submit any content that infringes upon a third party's contractual or property rights or any content that is illegal, false, misleading, defamatory, harassing, abusive or otherwise objectionable in nature. You agree that any content which is posted by You in violation of a third party's contractual or proprietary rights is done so by the User in direct contravention of the ecourse.org Membership Agreement, whether we are aware of the content or not, and You assume all responsibility for any litigation which may result from such a posting, including, but not limited to damages, reasonable attorney's fees, and costs and you agree to indemnify us for same.

You will not transfer any files, programs or e-mails containing any viruses, Trojan horses, worms, or other computer programming routines that may harm, corrupt, expropriate information from, or place a disproportionately large burden on the ecourse.org website, it's files or databases, or those of its Members.

You will not access or tamper with non-public areas of the ecourse.org site, or postings of other members or their files without the express, written authorization of ecourse.org.

You will not frame the ecourse.org site without the express, written permission of ecourse.org.


Responsibility of Members
Members are responsible for regularly reviewing the conditions and terms of this Membership Agreement.

ecourse.org is not responsible for the storage, upkeep, or maintenance of Member files or postings, and it is recommended that Members keep both saved and printed copies of the postings submitted to ecourse.org.

ecourse.org publishes information by the Members on good faith that the information provided is true and accurate. However, ecourse.org is unable to regulate the truth, accuracy, merit, or legitimacy of postings made by Users, nor can ecourse.org confirm the qualifications, background, or identity of other Members. ecourse.org entrusts the decision of whether or not to approve a registration or enrollment or to accept a particular posting entirely in the hands of the Member, and does not participate in the actual transactions between Members.

ecourse.org neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on the ecourse.org site by anyone other than authorized ecourse.org employees acting in their official capacities. You understand and acknowledge that ecourse.org is not responsible for and does not monitor third-party content for accuracy or reliability. You further agree that ecourse.org is not associated with, or liable for the content or resources of any links to other sites that We may include for the benefit of our Members.


Waivers and Indemnification


ecourse.org makes every effort to provide a convenient and functional service for its members. However, it does not guarantee that its web site will be error free or that the Site or the server that operates it are free of viruses or other harmful components. It is the responsibility of the User to maintain backup files adequately and to update virus detection software to protect the integrity or security of your computer system. If, as a result of Your direct or indirect use of the ecourse.org site, You determine that your property or equipment requires servicing or replacing, You hereby acknowledge that We are not responsible for any costs incurred.

IN ANY JURISDICTION WHERE SUCH WAIVERS OF WARRANTIES ARE NOT PROSCRIBED BY LAW, THE MEMBER USES THE ecourse.org SITE AT HIS OR HER OWN RISK, AND ALL SERVICES AND DATA ARE PROVIDED WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY SORT, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, OR NON-INFRINGEMENT. 

ecourse.org furthermore does not warranty any goods or services obtained through the use of the ecourse.org site from another Member or advertiser. Any dissatisfaction with teaching or learning performance or behavior is not the responsibility or fault of the ecourse.org site and the Member agrees to omit ecourse.org, its employees, agents and directors, as a party in any litigation which may result from such dissatisfaction. In jurisdictions where warranty waivers are proscribed, You agree that the Membership Agreement shall be enforced in its entirety, with only those waiver exclusions required by law excepted.

You agree to defend, indemnify, and hold harmless ecourse.org, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or resulting from Your use of the ecourse.org site or Your violation of this Membership Agreement.

You agree, in any jurisdiction where not proscribed by law, that neither ecourse.org, nor any of its officers, directors, employees or agents responsible for creating, maintaining, or delivering the ecourse.org site shall be liable for any direct or indirect damages resulting from your access, use of, or inability to access or use the ecourse.org site. In jurisdictions where such waivers are proscribed, You agree that the Membership Agreement shall be enforced in its entirety, with only those waiver exclusions required by law excepted.


Remedies of Member


It is acknowledged and accepted by the Member that the only remedy against ecourse.org, its officers, directors, employees or agents for any alleged damage caused by a performance or non-performance shall be the cancellation of the User's membership and the termination of further use of the service. The User agrees that any dispute, which may arise from this Membership Agreement or the ecourse.org membership, shall be settled through binding arbitration, whether based on tort, contract or other theory of law. Furthermore, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the ecourse.org site or the these terms and conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Any failure of ecourse.org to enforce, in part or in whole, any of the provisions herein listed shall not constitute a waiver of that provision or provisions or of the rest of these terms and conditions of membership.

Member Support
All requests for educational service and support should be made directly to other members who provide such service and support using this site in accordance with their terms and conditions. ecourse.org will provide on-line technical support on the operation and administration of this site.
